Terms of Service

These Terms of Service ("Terms") govern your access to and use of TextMyAgent (the "Service"), provided by KJ Bucketlist Inv, LLC ("Company," "we," "us," or "our"), available at https://textmyagent.app.

By signing up for or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TextMyAgent is a personal AI assistant delivered via SMS text message. The Service uses artificial intelligence to engage in 1:1 conversational messaging, remember preferences and context you share, and surface recommendations, check-ins, and other personalized content.

The Service is provided "as is." We may update, modify, suspend, or discontinue any part of the Service at any time.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service you represent that you meet these requirements.

3. Your Account

3.1 Signup

To use the Service you must provide your phone number, email address, payment information, and explicit consent to receive SMS messages from us.

3.2 Accuracy

You agree that information you provide is accurate and current. Keep it updated.

3.3 Security

You are responsible for activity on your account. Notify us immediately of any unauthorized use.

4. Subscription, Trial, and Payment

4.1 Free trial

Your account begins with a 30-day free trial from the date of signup. You may use the full Service during the trial at no cost. A payment method is required at signup but will not be charged during the trial.

4.2 Paid subscription

After the trial ends, your subscription automatically converts to a recurring paid plan unless you cancel before the trial ends. Pricing options:

Base TextAgent: $30.00 USD per month, billed monthly. Includes the personal AI agent over SMS, document handling, calendar coordination, email handling, and agent-to-agent coordination.
With Agentic Voicemail: $45.00 USD per month, billed monthly. Includes everything in Base plus a dedicated phone number provisioned for you, with full inbound call screening and outbound calling capability.

The default plan is Base. You may add the Agentic Voicemail tier at any time. Charges go to the payment method on file.

4.3 Automatic renewal

Your paid subscription renews automatically at the end of each billing period (monthly or annual) until cancelled. You authorize us to charge your payment method each billing cycle.

4.4 Cancellation

You may cancel at any time by:

Replying CANCEL to any TextMyAgent message, or
Replying STOP to any TextMyAgent message (opts you out of SMS and cancels billing), or
Emailing help@textmyagent.app

Cancellation takes effect at the end of your current billing period. You continue to have access to the Service until then.

4.5 No refunds

Payments are non-refundable except where required by applicable law.

4.6 Price changes

We may change pricing with at least 30 days' notice. Price changes take effect at your next billing cycle.

4.7 Taxes

Prices do not include taxes. You are responsible for any taxes applicable to your subscription.

5. SMS / Text Messaging Terms

5.1 Consent

By providing your phone number and signing up, you expressly consent to receive recurring text messages from TextMyAgent at the number provided, including automated messages. Consent is not a condition of any purchase.

5.2 Frequency

Message frequency varies based on your interactions. Up to 10 messages per day is typical; actual frequency may differ.

5.3 Rates

Message and data rates may apply per your carrier plan. TextMyAgent is not responsible for carrier charges.

5.4 Opt-out

Reply STOP to any message to opt out. You will receive one confirmation; after that, no further messages.

5.5 Help

Reply HELP to any message for assistance.

5.6 Carrier liability

Carriers are not liable for delayed or undelivered messages.

5.7 Supported carriers

The Service supports major US carriers. Availability through your specific carrier is not guaranteed.

5A. SMS Data Sharing — A2P 10DLC Compliance

5A.1 No third-party or affiliate marketing

TextMyAgent does not engage in affiliate marketing, third-party lead generation, or any activity that involves sharing, selling, or transferring your phone number or opt-in information to third parties for marketing or promotional purposes.

5A.2 Mobile information and messaging consent

Mobile information and messaging consent are not shared with third parties or affiliates for marketing or promotional purposes. This applies to all information collected at signup, all data exchanged via SMS, and all derived profile information.

5A.3 Operational service providers only

The only parties that receive data from us are operational service providers — Amazon Web Services, Anthropic PBC, Twilio Inc., and Stripe Inc. — acting under contractual confidentiality and only for the purpose of delivering the Service to you. These providers are not authorized to use your information for their own marketing purposes.

5A.4 Direct consent to KJ Bucketlist Inv, LLC

When you opt in to receive SMS messages from TextMyAgent, you are providing consent directly to KJ Bucketlist Inv, LLC, the operator of TextMyAgent. Your consent is not bundled with consent to any other entity, brand, or affiliate.

6. Acceptable Use

You agree that you will not:

Use the Service for any unlawful, harassing, harmful, or abusive purpose
Attempt to gain unauthorized access to the Service, other accounts, or our systems
Impersonate another person or misrepresent your identity
Use the Service to distribute spam, malware, or unsolicited advertising
Attempt to reverse engineer, decompile, or extract the underlying models or training data
Use automated means to interact with the Service in ways designed to abuse rate limits or extract bulk information
Share your account with others

We may suspend or terminate your account for violation of this section without notice and without refund.

7. Content and Conduct

7.1 Your messages

You retain ownership of the messages you send to the Service. By sending messages you grant us a limited license to process, store, and use them to operate the Service, personalize your experience, and improve the Service.

7.2 No training on your personal data for third parties

We do not use your messages to train third-party AI models. Messages may be used to improve internal systems.

7.3 AI-generated responses

Responses from TextMyAgent are generated by an AI language model. While we strive for quality, AI responses can be incorrect, incomplete, or inappropriate in rare cases. Do not rely on the Service as a substitute for professional advice.

7.4 No medical, legal, financial, or mental health advice

The Service is not a licensed medical, legal, financial, or mental health professional. Nothing said by TextMyAgent constitutes professional advice. For medical emergencies or crisis support, contact 911 or the 988 Suicide & Crisis Lifeline.

8. Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.

9. Intellectual Property

The Service, including software, design, personality, prompts, and branding, is owned by KJ Bucketlist Inv, LLC and protected by US and international intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from the Service or its underlying technology.

10. Third-Party Services

The Service uses third-party providers including Amazon Web Services, Anthropic, Twilio, and Stripe. Your use of the Service is also subject to the terms of these providers where applicable.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT RESPONSES FROM THE AI WILL BE ACCURATE, COMPLETE, OR RELIABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KJ BUCKETLIST INV, LLC OR ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the minimum extent permitted by law.

13. Indemnification

You agree to indemnify and hold KJ Bucketlist Inv, LLC harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, for non-payment, for abuse, or for any reason at our discretion. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive (payment obligations, disclaimers, limitations of liability, indemnification, governing law) will survive termination.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. You agree that any dispute arising from or related to the Service or these Terms will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date and, where practical, by sending you an SMS or email notice. Continued use of the Service after changes take effect constitutes acceptance.

17. Entire Agreement; Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KJ Bucketlist Inv, LLC regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
